U.S. Department of Labor issues guidance on Notice to Employees of Coverage Options under Fair Labor Standards Act – May 8, 2013
The Affordable Care Act added a requirement to the Fair Labor Standards Act stating that employers must notify employees of coverage options available through the Exchange. The U.S. Department of Labor (DOL) recently made model notices available to distribute to employees. Employers must issue this notice to current employees by October 1, 2013 and to new employees within 14 days of their start date. CDPHP will send a reminder about this notice to employers in August. Feds Announce Exchange Notification Postponement – January 29, 2013
On Jan. 24, 2013, federal regulators postponed the “notice of exchange” requirement for employers indefinitely. The law, which is part of The Affordable Care Act, originally required employers to give written notice to employees about the availability of public health insurance exchanges by March 1, 2013.

The Department of Labor (DOL) expects that the timing for distribution of notices will be the late summer or fall of 2013, which will coordinate with the open enrollment period for exchanges. The DOL is considering providing model, generic language that could be used to satisfy the notice requirement.

The Departments of Health and Human Services, Treasury and Labor jointly issued FAQ regarding the delay of this notification requirement.
